When Paternity Matters
Establishing paternity matters in all family law cases in which the parental rights and responsibilities of the father must be recognized. Sometimes this is because a mother needs her co-parent to pay child support. Other times, a father may be fighting for access to their child.
Paternity plays a significant role in matters concerning:
- Establishing legal parentage
- Child custody

- Other financial concerns for the child (school, medical expenses, etc.)
How Do I Establish Paternity?
In Illinois, there are two different ways to establish the paternity of the child. The most common way is executing a Voluntary Acknowledgment of Paternity at the hospital. These are documents the father signs following the birth of the child that are legally binding and can be referred to later in court if ever needed.
The second is a DNA test. DNA tests can be ordered by the court when there is disagreement between unmarried parties over the parentage of the child. A judge can order these tests to be safely and promptly conducted by a trusted medical professional. Once the results are in, the legal matter can proceed.
